These Terms of Use (the "Terms") govern access to and use of the Al Jamal application ("Al-Jamal"), the Kalimo website, content, subscriptions, and related services, together: the "Service".

The Service is operated under the Kalimo brand by ATIA Group ("Kalimo", "we", "us", or "our").

These Terms are intended for private users in Israel. Engagements with companies, public bodies, organizations, and institutional customers may be subject to a separate agreement.

By creating an account, using the Service, or purchasing a subscription, you confirm that you have read these Terms and the Privacy Policy and agree to them.

1. Eligibility and Use by Minors

The Service is intended for use in accordance with applicable law.

If the user is a minor, use of the Service and purchase of paid services are subject to consent of a parent, guardian, or legal representative, where such consent is required by law.

Nothing in these Terms derogates from legal provisions regarding the legal capacity of minors.

2. Description of the Service

Al-Jamal is an application for learning and practicing language, and in particular spoken Arabic.

The Service may include, among other things, vocabulary databases, lessons, audio recordings and pronunciation, learning paths, games, quizzes, exercises, translation, transliteration, explanations, progress tracking, artificial-intelligence-based features, conversations and interactive practice, as well as additional services we may add from time to time.

Part of the Service is available without payment and part is available only through a subscription or paid purchase.

The Service is intended for personal, educational, and non-commercial use only.

3. Free Trial Period

A new user is entitled to a free trial period of 10 days, starting on their first entry into the application.

At the start of the trial period, the user will be shown that the trial has begun. At the end of the 10 days, the trial will end automatically and the user will move to the free, limited version of the Service, unless they proactively choose to purchase a paid subscription.

The trial period offered by Kalimo does not require entering a payment method and does not automatically convert into a paid subscription. No charge will be made solely because the trial period ended.

The trial period is available only once per user. Kalimo may identify prior use, including through email address, Google account, Apple account, or another reasonable identifier linked to the account.

Opening additional accounts or using other means to obtain multiple trial periods constitutes misuse of the Service.

4. User Account

The user is responsible for safeguarding account sign-in details and providing accurate, up-to-date information.

You may not share a personal account with others, impersonate another person, create fictitious accounts, or use multiple accounts to exploit trial periods, discounts, promotions, or paid services.

A subscription linked to a user account may be available on different devices where the user signs in to the same account, subject to technical compatibility of the Service and the terms of the platform through which the purchase was made.

Deleting the user's Al-Jamal account does not automatically cancel an active subscription purchased through the App Store or Google Play.

A user with a renewing subscription must cancel renewal through the Apple or Google account used for the purchase. We recommend doing so before deleting the Al-Jamal account.

Removing the application from the device does not constitute cancellation of a subscription.

Account deletion does not prevent retention of information that Kalimo is required or permitted to retain under law, including accounting information, transaction records, and information needed to handle disputes.

5. Premium Plans and Pricing

Kalimo may from time to time offer different Premium plans, including monthly, annual, and plans for additional periods.

As of the date of these Terms, the planned prices of the main plans are:

Availability of plans, prices, billing periods, renewal terms, and any other commercial term may vary between the App Store and Google Play and according to the time of purchase.

The binding price and binding purchase terms are those clearly displayed to the user in the relevant store before transaction confirmation.

The price displayed by the store may include taxes, adjustments, or other components in accordance with law and the relevant platform's policy.

Kalimo may from time to time offer promotions, benefits, discounts, and special prices, subject to the mechanisms and rules of the relevant store.

Unless stated otherwise, benefits may be limited to one-time use, and Kalimo may limit repeated use of a benefit already used by the same user or account, subject to Apple or Google rules and applicable law.

6. Renewing Subscriptions and Automatic Renewal

A plan presented in the store as a subscription that renews automatically will renew according to the billing period shown to the user at purchase, unless the user cancels renewal in accordance with the relevant store's rules.

By confirming purchase of a renewing subscription, the user confirms the billing and renewal terms as displayed by the App Store or Google Play before completing the purchase.

Management of payment methods, billing dates, and renewal procedures is performed through Apple or Google, as applicable.

The user may cancel automatic renewal through the subscription management tools of the store where the purchase was made.

As a rule, cancelling automatic renewal prevents future charges and does not immediately stop the Service for the period already paid. The user will continue to enjoy Premium access until the end of the paid period, unless the relevant store, applicable law, or a refund decision provides otherwise.

7. Fixed-Term Plans

Kalimo may offer plans paid in advance for a fixed term that do not renew automatically.

In such cases, the user will be shown before purchase the service period, price, and whether the plan renews automatically or ends without further charge.

If the plan does not renew automatically, at the end of the period the subscription will end and the account will move to the free version of the Service, unless the user purchases another plan.

If a particular plan is defined by the App Store or Google Play as automatically renewing, Section 6 above will apply even if its billing period is one year or another period.

8. Subscription Cancellation and Refunds

A distinction should be made between cancelling subscription renewal and requesting a monetary refund.

Cancelling renewal of a renewing subscription is intended to prevent future charges and is done through the subscription management mechanisms of the App Store or Google Play, according to the platform where the purchase was made.

Cancelling renewal does not by itself grant an automatic right to a refund for the period already paid.

Requests for monetary refunds for purchases made through the App Store or Google Play may be handled through the relevant store, in accordance with its mechanisms, policies, and applicable law.

Where the store allows Kalimo to handle a refund request or issue a refund directly through its developer tools, Kalimo may do so in accordance with its policies, the circumstances of the case, and applicable law.

Kalimo may direct a user requesting a refund to Apple's or Google's refund mechanism when the refund must or should be processed through the platform where the transaction was made.

Nothing in this section derogates from a right of cancellation, refund, or other consumer right to which the user is entitled under non-waivable law.

9. Statutory Cancellation Rights

Nothing in the cancellation or refund policies of Kalimo, Apple, or Google derogates from a right of cancellation, monetary refund, or other consumer right that cannot be waived under Israeli law.

Among other things, in distance sales or ongoing transactions, consumers may have cancellation rights at times and under conditions set in the Consumer Protection Law, 1981, and applicable law.

Where the Service has already begun to be provided at the time a statutory cancellation right is exercised, Kalimo may charge or deduct only amounts permitted by law.

Where cancellation arises from a defect in the Service, non-conformity, non-delivery, or other breach by Kalimo, cancellation and refund will be handled in accordance with the legal provisions applicable in that case.

Consumers entitled under law to an extended cancellation period, including in certain cases senior citizens, new immigrants, and persons with disabilities, will be entitled to the rights set in law according to the conditions that apply to them.

Where there is a gap between the relevant store's policy and a right the user is entitled to under a mandatory provision of Israeli law, nothing in these Terms derogates from the user's statutory right.

10. How to Cancel

Cancelling Subscription Renewal

Kalimo may display within the application a link or option directing the user to the relevant subscription management screen.

Deleting an Al-Jamal account or removing the application from the device does not constitute cancellation of an active subscription.

Cancellation or Refund Request Under Law

You may contact Kalimo regarding cancellation, refund, or transaction inquiry through:

And through any additional method Kalimo is required to allow under law.

To locate the account or transaction, we may ask the user to provide reasonable details needed for identification, such as name, email address associated with the Al-Jamal account, the platform where the purchase was made, and transaction identifier or order number, where available.

Kalimo will not require details that are not necessary to locate the transaction, verify the requester's identity, or fulfill a legal obligation.

Where additional identifying details must be provided under law as part of a cancellation notice, Kalimo may request them to handle the request.

Kalimo does not require the user to state a reason for cancellation, except where certain information is required by the relevant store to handle the request. Kalimo may optionally request feedback on the reason for cancellation to improve the Service.

11. Payments and Processing via App Store and Google Play

Purchases made in the application on Apple devices are processed through the App Store purchase system.

Purchases made in the application on Android devices are processed through Google Play Billing.

The payment process, including selection of payment method, storage of payment method details, payment verification and charging, is managed by Apple or Google, as applicable, in accordance with the terms and policies of the relevant platform.

Kalimo does not receive or store the user's full credit card number or credit card security code.

Kalimo may receive from Apple or Google limited information regarding the transaction and subscription status, such as transaction identifier, type of product or subscription purchased, purchase date, entitlement period, renewal status, expiration date, information regarding cancellation or refund, and other technical information needed to operate the Service, provide support, and manage user entitlement.

Documents, purchase confirmations, receipts, or payment-related documents may be sent or made available through Apple or Google, according to the platform where the purchase was made and the rules that apply to it.

Use of App Store and Google Play payment systems is also subject to the terms, privacy policies, and payment and refund policies of Apple or Google, as applicable.

12. Payment Failures, Transaction Cancellation, and Refund

If the relevant store reports that a purchase cannot be completed, the subscription or Premium entitlement will not be activated based on that purchase.

If renewal charging for a renewing subscription fails, handling of additional charge attempts and subscription status will be in accordance with Apple or Google mechanisms.

Kalimo may update the user's Premium entitlement according to transaction or subscription status as reported by the relevant platform.

If Apple or Google cancelled a transaction, approved a refund, cancelled a subscription, voided a transaction, or notified that the purchase is no longer valid, Kalimo may stop access to content or services provided under that purchase, according to the date and status reported by the platform.

Nothing herein derogates from a user's right in good faith to dispute an unrecognized charge or exercise any right available under law.

In case of well-founded suspicion of fraud, impersonation, intentional abuse of payment systems, or provision of false information, Kalimo may suspend the account and take appropriate measures, subject to law.

13. Price Changes

Kalimo may change subscription and product prices from time to time.

A price change will not retroactively change the price of a period already paid.

A price change for a subscription renewing through the App Store or Google Play will be made subject to the mechanisms, rules, and notice or consent requirements of the relevant platform and applicable law.

Where user consent to the new price is required, the new price will apply only after the required consent is obtained.

For a plan that does not renew automatically, a new price will apply only to a future purchase made by the user.

14. Intellectual Property

All rights in the Service and in content owned by Kalimo or licensed to it are reserved to their owners.

These rights may include, among other things, trade names, logos, symbols, design, illustrations, animations, characters, sounds, user interfaces, educational content, texts, translations, examples, exercises, recordings, software, code, databases, and technological components.

Without prior written approval, you may not copy, distribute, sell, publish, reproduce, reverse engineer, extract information, scrape information, use automated tools to create a competing database, or make unauthorized commercial use of the Service or its content.

15. Prohibited Use

You may not use the Service unlawfully, attempt to breach or bypass security mechanisms, inject malicious code, harm the Service or other users, artificially exploit trial periods or promotions, commit payment fraud, impersonate others, or use the Service to develop a competing product through unauthorized copying of Kalimo content.

16. Violations, Suspension, and Account Closure

In case of a material breach of these Terms, reasonable suspicion of fraud, harm to Service systems, unlawful use, or risk to users or Kalimo, we may, subject to law, suspend or restrict the account, remove access to the Service, or close the account.

In serious cases, immediate suspension may be applied where required to protect the Service, users, or Kalimo systems.

Where appropriate, Kalimo may take legal action or contact competent authorities.

Nothing in this section allows Kalimo to deny the user a refund or other right to which they are entitled under law.

17. Artificial Intelligence Features

Some Service features may rely on artificial intelligence systems and external service providers.

Within certain features, content the user provides, such as voice, speech, or transcription, may be processed to operate the Service, in accordance with the Privacy Policy.

Output generated through artificial intelligence may be wrong, partial, inaccurate, or unsuitable for a particular context.

Do not rely on responses generated through the Service as a substitute for professional advice, and we do not commit to full accuracy of translations, transliterations, pronunciation corrections, responses, or explanations generated through automated systems.

18. Educational Content and No Outcome Guarantee

The Service is intended as a tool to assist language learning and practice.

Kalimo does not guarantee that the user will achieve a particular language level, pass a test, course, interview, or other assessment, or that use of the Service will yield a particular academic, professional, or personal outcome.

Arabic includes dialects, regional differences, pronunciation forms, and varying interpretations. Although we invest effort in creating quality content, errors or disagreements may arise regarding translation, transliteration, pronunciation, grammar, or meaning.

19. Service Availability and Changes

We strive to provide an available, proper Service, but we do not guarantee continuous, fault-free operation.

The Service may be affected by maintenance, technical failures, updates, internet connectivity, failures at third parties including Apple and Google, and technological changes.

Kalimo may add, change, or remove features from time to time.

A material change that significantly impairs prepaid Service will be made subject to the user's rights under law.

If Kalimo permanently ceases to provide the Service entirely, a user who prepaid for a future period that will not be provided will be entitled to treatment in accordance with law and the relevant refund mechanisms of the platform where the purchase was made.

20. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available".

Kalimo does not guarantee that the Service will always be free of errors, interruptions, malfunctions, or inaccuracies.

To the maximum extent permitted by law, Kalimo and its officers will not be liable for indirect or consequential damages arising from use of the Service, inability to use it, or unreasonable reliance on educational content or content generated through artificial intelligence.

Nothing in these Terms exempts Kalimo from liability that cannot be limited or excluded under law.

21. Updates to the Terms

Kalimo may update these Terms from time to time due to changes in the Service, law, business model, Apple or Google policies, or operational reasons.

When a material change relates to a paid subscription, price, user rights, or material obligations, we will provide reasonable advance notice, and where the law requires consent, the change will be subject to obtaining the required consent.

The current version of the Terms will be published on the Kalimo website with the date of the last update.

22. Privacy

Use of the Service is also subject to Kalimo's Privacy Policy.

Information related to the account, purchases, subscription status, use of the Service, and AI-based features will be processed in accordance with the Privacy Policy and applicable law.

When a purchase is made through the App Store or Google Play, certain information regarding payment and the transaction is processed directly by Apple or Google in accordance with their privacy policies and terms.

23. Governing Law and Jurisdiction

These Terms and use of the Service are governed by the laws of the State of Israel.

Any dispute will be heard by the competent court in accordance with legal provisions.

Nothing in this section derogates from local jurisdiction or a procedural right that cannot be waived under law.

24. General Provisions

If any provision of these Terms is held unlawful, invalid, or unenforceable, that will not affect the validity of the remaining provisions.

Kalimo's failure to exercise a particular right in a particular case does not constitute a waiver of that right in the future.

In case of conflict between these Terms and a non-waivable legal provision, the legal provision prevails.

Inquiries regarding a subscription purchased through the App Store or Google Play may also require use of the support, subscription management, or refund mechanisms of the platform where the purchase was made.
